Grandparent's Rights

New Hampshire law includes provisions for grandparent's rights, which allow for visitation by grandparents in some situations. Grandparents can petition the court for grandparent's rights of visitation as long as their access to the child has not been restricted prior to the divorce. The court will consider whether to grant grandparent's rights of visitation based foremost on the best interests of the child. Additional criteria the court uses to asses grandparent's rights include possible interference with the child-parent relationship, prior relationship of the grandparents with the child, the wishes of the child, and any other relevant factors. The court can make modifications to grandparent's rights based on changing circumstances of any of the parties involved. Above all, grandparent's rights must be in the best interests of the child.
